Class Certification Granted For Connecticut and Rhode Island Classes In Land Rover Class Action

On November 1, 2012, after considering briefing and oral argument by Shepherd Finkelman Miller & Shah's James Shah, the Honorable Grant Miller of the Superior Court of Connecticut, Hartford Division, certified classes of Connecticut and Rhode Island consumers in a case pending against Jaguar Land Rover North America, LLC ("Land Rover"). Plaintiffs asserted consumer protection claims under Connecticut and Rhode Island law, breach of warranty and unjust enrichment claims in a case involving an alleged alignment geometry defect in model year 2005 and 2006 Land Rover LR3 vehicles. Joining the Ninth Circuit, the Central District of California, and the Superior Court of California, Judge Miller found certification to be appropriate and certified the following claims: (1) Connecticut Product Liability Act; (2) breach of express and implied warranty; (3) Connecticut Automobile Warranty Adjustment Act; and (4) Rhode Island Deceptive Trade Practice Act.
