On April 10, 2007, Shepherd, Finkelman, Miller & Shah, LLC, along with its co-counsel, The Mason Law Firm, LLP, filed a Class Action Complaint in the United States District Court for the District of Connecticut against Carrier Corporation (“Carrier”) on behalf of Andrew Zajac and a proposed class consisting of all persons or entities in the United States that own or owned a heating, ventilating and air conditioning (“HVAC”) system containing a Performance™ Series evaporator coil (“Coil”) that incurred labor costs related to the replacement of the Coil, repair of the HVAC system as a result of a Coil leak, or other property damages caused by a Coil leak during the five (5) year warranty period.
The Complaint alleges that the Coils often fail during their useful life due to corrosion. The Complaint also alleges that despite the defective nature of the Coils, Carrier does not include labor in its warranty coverage and does not advise or warn consumers that they should purchase extended warranty coverage. Through the Complaint, Plaintiff brings claims against Carrier for breach of state warranty laws and negligence in its design, manufacturing, advertising and selling of the Coils because Carrier knew or should have known of the Coils’ propensity to corrode and leak.
