Court Rules in Favor of Plaintiffs in Safeway Judgment

Shepherd, Finkelman, Miller & Shah, LLP is pleased to announce that on November 30, 2015, U.S. District Court Judge Jon S. Tigar of the Northern District of California approved a judgment in favor of the certified class, represented by Plaintiff, Michael Rodman ("Plaintiff"), against Defendant, Safeway Inc. ("Safeway"), awarding damages of $30,979,262, along with prejudgment interest of $10,905,505, for a total of $41,884,767. In this action, Plaintiff alleged that Safeway breached its contracts with customers who ordered groceries on-line by overcharging them. Specifically, Plaintiff alleged that, although Safeway's contracts promised its customers that the prices charged for groceries available for on-line ordering would be the same as the prices charged in the physical store from which the groceries were selected and delivered, Safeway added a ten percent charge on most items.
