SFMS Assists In Filing Amicus Brief In The Supreme Court Of The State of California

Patrick A. Klingman of Shepherd, Finkelman, Miller & Shah, LLP, along with Consumer Action, Consumer Federation of California, the National Association of Shareholder and Consumer Attorneys and Huskinson, Brown, Heidenreich & Carlin, prepared an amici curiae brief in Estuardo Ardon v. City of Los Angeles, Case No. S174507, pending before the California Supreme Court. Initially filed in the Los Angeles Superior Court, the issue on appeal was whether claims for tax refunds could be brought against municipalities as class actions and how lower courts have diverged in their conclusions on this issue. In the brief, amici takes the position that the California Legislature has determined how tax refund claims may be prosecuted against municipalities, and that class claims for such tax refunds are permitted by Section 910 of the California Government Claims Act.
