Summary of Pending Case: On August 28, 2008, Shepherd, Finkelman, Miller & Shah, LLP, along with co-counsel, filed a Class Action Complaint against Defendant Time Warner Cable Inc. (“Time Warner” or “Defendant”) in the United States District Court for the Southern District of New York. The case is pending before the Honorable P. Kevin Castel. The case is brought on behalf of all persons who purchase Premium Cable Services from Time Warner and are compelled to pay cable box rental fees to Time Warner. Through the Complaint, Plaintiffs allege that Time Warner’s actions constitute an impermissible restraint of trade in violation of Section 1 of the Sherman Act, 15 U.S.C.
Status of Pending Case: On April 17, 2009, Plaintiffs filed their First Amended Complaint (“Amended Complaint”). Defendant has moved to dismiss Plaintiffs’ Amended Complaint. Oral argument on Defendant’s Motion took place on March 3, 2010. The Court granted Defendant’s Motion to Dismiss, however, the Court has allowed Plaintiffs leave to amend. Plaintiffs anticipate filing a further amended complaint no later than April 9, 2010.
