Summary of Pending Case: On May 8, 2006, Shepherd, Finkelman, Miller & Shah, LLP, along with co-counsel, filed a Class Action Complaint (“Complaint”) on behalf of Plaintiffs, Mike and Tracy D’Andrea, against Defendants, K. Hovnanian, Hovnanian Enterprise, Inc. and K. Hovnanian Venture I, LLC (collectively “Hovnanian” or “Defendants”), in the Superior Court of New Jersey, Gloucester County. The case is assigned to the Honorable Jean McMaster. The Complaint alleges that Defendants routinely and systematically constructed homes containing HVAC systems that were improperly designed and installed in a manner that violated applicable construction codes with respect to fireblocking. The Complaint further alleges that, as a result of this practice, the HVAC systems are substandard, unsafe, require repair, and Plaintiffs and all class members have been damaged. Plaintiffs, on behalf of class members, allege violations of the New Jersey Consumer Fraud Act and seek recovery for breach of contract.

Status of Pending Case: On July 13, 2007, Plaintiffs filed an Amended Complaint. The parties are currently engaged in discovery. A case management conference occured on March 26, 2010.
