Summary of Pending Case: On March 16, 2010, Shepherd, Finkelman, Miller & Shah, LLP filed a Class Action Complaint (“Complaint”) in the Superior Court of California for the County of Los Angeles on behalf of Plaintiff, James Gray (“Gray” or “Plaintiff”), and a proposed class of California consumers against Langer Juice Company, Inc. (“Langer” or “Defendant”). The Complaint alleges that Defendant engaged in fraudulent, deceptive and otherwise improper advertising, sales and marketing practices regarding its Pomegranate Juice Products (“Products”). The Complaint further alleges that Langer has made, and continues to make, misrepresentations and/or omissions regarding the Products. Specifically, the Products, which have been packaged, advertised, marketed and sold by Langer based on the label and other forms of advertising to Plaintiff and others similarly situated, represent that the Products contain either 100% pomegranate juice or an otherwise significant percentage of pomegranate juice, when, in actuality, the Products are primarily composed of less expensive apple and white grape juice, a fact which, the Complaint alleges, Langer knew and purposely misrepresented and failed to disclose to its consumers.
Status of Pending Case: Langer has filed a demurrer and a hearing on Defendant's motion is scheduled for October 5, 2010. There is a case management conference scheduled for August 5, 2010.
