(Nasdaq: GS) may have been damaged by certain actions related to knowledge within the company concerning the marketing of ABACUS 2007-AC1 (“ABACUS”), which is a synthetic collateralized debt obligation (“CDO”) that was marketed to investors in early 2007. The CDO is tied to subprime residential mortgage-backed securities and was at the heart of the credit crisis in 2007. The Securities and Exchange Commission recently filed a complaint against Goldman Sachs and one of its vice presidents for defrauding investors by misstating and omitting key facts about ABACUS.
