Our legal team supported the Parmigiano Reggiano Consortium in requesting that the U.S. canning industry remove the images because they were misleading to consumers.
Parmigiano Reggiano is a protected designation of origin (PDO) for the specific cheeses produced in the provinces of Parma, Reggio Emilia, Modena, and areas of Bologna and Mantua (Lombardy). The distinctive trademark of origin displays the dotted inscription “Parmigiano Reggiano” on the outer covering of the cheese wheel. On the labels of some of its Prego line of sauces, the Campbell Soup Company included photos of the distinctive cheese wheel with the dotted inscription, implying that the authentic Parmigiano Reggiano cheese was one of the Prego sauce ingredients, when in fact, it was not.
The Consortium’s victory is significant as the Campbell Soup Company is a large conglomerate with a market cap of more than $15.25 billion. In contrast, Consorzio Parmigiano Reggiano is a relatively small Italian consortium of cheese producers who have been making their cheese for hundreds of years. The Consortium traces its roots back to 1901, when the Chamber of Commerce of Reggio Emilia sought to establish a trade union to authenticate the origin of the unique type of product they exported. In 1926, the Dairy International Congress moved to define the names and types of cheese from their areas of origin to prevent fraud.
