On February 7, 2006, SFMS filed a shareholder derivative complaint on behalf of the International Brotherhood of the Teamsters in the Delaware Chancery Court for the benefit of Coca-Cola Enterprises, Inc. against The Coca-Cola Company and certain Officers and Directors of Coca-Cola Enterprises, Inc. The Complaint asserts claims against these Defendants for breaches of fiduciary duty, breaches of the duty of loyalty and abuse of control.
