SFMS announces that it will be joining a wage and hour class action against Virgin America as co-counsel. The case, captioned Julia Bernstein, et al. v. Virgin America, Inc., 227 F. Supp. 3d 1049 (N.D. Cal. 2017), is pending in the U.S. District Court of the Northern District of California, and is being presided over by The Honorable Jon S. Tigar.
Julia Bernstein and all others similarly situated (collectively referred to as “Plaintiffs”) bring this action against Virgin America, Inc. (“Defendant”) for its allegedly unlawful employment practices – specifically, its compensation scheme that allegedly denies Plaintiffs the wages and benefits to which they are lawfully entitled. Among other things, Plaintiffs are claiming that Defendant implemented policies that failed to pay employees for all hours worked (including hours worked in excess of eight hours per day or 40 hours per week) and failed to provide meal periods and rest breaks.
