SFMS Secures Jury Verdict Of Over $2 Million For First 11 Class Members In Field Asset Services Trial

After a two-week trial, on July 17, 2017, a jury returned a verdict in favor of the first 11 class members whose claims were tried in Bowerman v. Field Asset Services, Inc., Case No. 13-cv-00057-WHO (N.D. Cal.). The jury verdict was for a total of approximately $2.06 million, which included individual awards that ranged from $14,000 to over $200,000 for unpaid overtime and unreimbursed business expenses.

There are more than 200 class members who have claims against FAS. The judge still has to decide how the claims for the remaining class members will be tried. We have a hearing with the court on August 15th, and we expect to know more after that hearing. The court may do any number of things including: order another jury trial for another group of class members; order some other process to permit class members to prove damages for unpaid overtime and unreimbursed business expenses; or pause the case and permit FAS to appeal the jury’s verdict and also the judge’s earlier decisions to certify the class and to find that class members were FAS’s employees, not independent contractors. There is also some possibility that we will try to resolve the case through a settlement, although no settlement discussions are currently taking place.
